REGULAR MEETING
April 11th, 1938
The regular meeting of the City Council of the City of Dover was held on the 11th day of April, 1938. The meeting was called to order by mayor Woodford and on roll call the following members answered present: Messrs. LeFevre, Downes, Frear, Burton, Keith, Vane and Hinkle.
MINUTES
Upon motion of Messrs. Hinkle and Downes, the reading of the minutes of the last regular meeting was dispensed with.
CITY MANAGER’S REPORT
The City Manager’s report for the month of March was read by the Clerk and accepted upon motion of Messrs. Keith and Hinkle.
Upon motion of Messrs. Hinkle and Burton, the City Manager was instructed to notify Mr. Alden Smith that he must lay a sidewalk on Sacarackin Avenue adjoining his property and that the City would fix the terrace along his property at their expense.
Upon motion of Messrs. LeFevre and Downes, the City Manager was instructed to confer with the property owner of two houses on Division and Forrest Streets next to the Booker T. Washington School and make proper arrangements to move these houses back in order that the State Highway Department may have the right-of-way for sidewalks from the railroad to the Booker T. Washington School.
Upon motion of Messrs. LeFevre and Keith, Council voted to assume the expense of current for lighting the Highway from Silver Lake Bridge to the Rehoboth cut-off, the Highway Department to bear the expense of installing all necessary equipment for this improvement.
Upon motion of Messrs. Keith and Hinkle, Council voted to waive all taxes, light and water bills on the colored Knights of Pythias Hall as long as the Rotary Club sponsors the recreation center in this building, taxes to be waived only for the years while the building is being used for this purpose.
Upon motion of Messrs. Hinkle and Keith, the City Manager was instructed that the installation of sewers on Lincoln Street be deferred until fall on account of the high water leverl existing in that section during the spring and summer seasons, the City Clerk to notify residents of that section of the change.
FINANCIAL REPORT
The financial report for the month of March was read by the Clerk and accepted and approved upon motion of Messrs. Keith and Hinkle.
ALDERMAN’S REPORT
The Alderman’s report for the month of March was read by the Clerk and accepted upon motion of Messrs. Burton and Keith. A check amounting to $111.00 was turned over to the City Manager with the report of four arrests.
POLICE REPORT
The report of the Chief of Police was read by the Clerk and accepted upon motion of Messrs. Hinkle and Burton.
COMMITTEES
Mr. Turpin from the Dover Airport appeared before Council regarding a lease on the airport which expired April 1st, 1938. After some discussion Council voted, upon motion of Messrs. Keith and Burton, to continue the airport under its present conditions for one year beginning April 1st, 1938.
Mr. Ernest V. Keith appeared before Council asking permission to open a driveway from the Loockerman Street plaza to the rear of his property adjoining the M. E. Church, this driveway to run into a private garage located on his property. After some discussion, during which Mr. Keith presented blue-prints and drawings of his contemplated improvements to the property, the City Council granted permission to open a driveway from the Loockerman Street plaza to his property line. Also, they granted an easement for a sidewalk entrance from State Street along the side of his building to his residential quarters, this walk not to exceed 5’ in width; provided, however, that the improvements made to this property comply with the architect’s drawings as presented to City Council by Mr. Keith in regards to the outside appearance of the buildings when completed, and the laying of this walk and driveway are to be under the supervision and cooperation of the property owner and the City Manager.
REPORT OF THE CITY BOARD OF HEALTH
A report of the City Board of Health, H. C. Taylor, Secretary was read by the Clerk. Upon motion of Messrs. Burton and Hinkle, the report was accepted and ordered filed, and the salary of the Secretary, amounting to $50.00, and the annual appropriation for expenses for the year, amounting to $35.00, were ordered paid.

The following ordinances were adopted by Council by the recorded vote of same as follows:

AN ORDINANCE RELATING TO THE BUILDING LINES IN THE ERECTION OR ALTERATION OF BUILDINGS WITHIN THE CITY LIMITS.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
SECTION 1. That Chapter XI of the Ordinances of the City of Dover relating to Building Commission be and the same is hereby amended by adding at the end of Section 3 of said Chapter XI a new paragraph to be known as Paragraph f, as follows:
(f) The location of such building, structure or any additions or alterations to be made to any existing building or structure with reference to the building line and property line abutting on any street or streets upon which such building or structure is to be erected, constructed, altered or repaired. All buildings hereafter erected, and all additions or alterations to any existing building or buildings shall conform to the common or established building line of the properties located in the block or section where such building is to be erected, changed or altered. No permit shall be granted for the construction, alteration or repairs of any building or buildings which would extend beyond the common or established building line of the street, block or section where such building or structure is to be built, constructed, altered or repaired, provided, however, that nothing herein contained shall prevent repairs to be made to existing buildings.

AN ORDINANCE CREATING A CITY PLANNING COMMISSION FOR THE CITY OF DOVER AND DEFINING ITS POWERS
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
SECTION 1. That there is hereby created a City Planning Commission for the development, improvement and beautification of the City.
SECTION 2. That said Commission shall consist of five members, as follows:
The Mayor of the City of Dover; two members of Council, to be selected by and designated by the Council of the City of Dover; and, two members to be selected and designated by the Garden Club of the City of Dover.
SECTION 3. Within thirty days next after the passage and approval of this ordinance, the Council of the City of Dover shall designate two of its members to serve on said Commissin until the next annual meeting of the Council of the City of Doer, to be held in the month of February, 1939, and the said, the Garden Club of the City of Dover, shall likewise designate two of its members to serve on said commission for a like term. Beginning with the year 1939, the persons designated to serve on said Commission shall serve fore a term of one year next after their appointment.
Vacancies in said Commission shall be filled either by the Council in the event that such vacancy be caused by a member of Council or by the Garden Club of the City of Dover in the event that such vacancy be caused by a member of said club.
SECTION 4. It shall be the duty of the said Commission to make a survey of the City of Dover and to make recommendations resulting from such survey to the Council of the City of Dover, together with such plan or plans as to said Commission seem appropriate for the development, improvement and beautification of the said, the City of Dover.
SECTION 5. The said Commission shall have no authority to bind the City of Dover or any of its agents, officers or departments for any expenses entailed in making such survey, unless permission shall have first been obtained from the Council of the City of Dover, and a fund set aside covering the same.

BUILDING PERMITS
A building permit of William Hurley, Sr., for a $200.00 residence on Hurley Hill was presented to Council, and the City Manager was instructed to notify Mr. Hurley that they would not grant this permit.
A building permit of G. G. Richardson for alterations of a building for the purpose of housing two ponies was presented to Council, and the City Manager was authorized to grant this permit.
