REGULAR MEETING
June 11, 1956
The regular meeting of City Council was held Monday, June 11, 1956, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Biddle, Davis, Hayes, Holpp, Mundy, Petty, Tischer and Zartman.
MINUTES
Minutes of the last special meeting were accepted as read.
REPORTS
Report of the Alderman Dempsey was accepted as read. Checks in the amounts of $2695.85, 121,00, $19.85, $29.85 and $154.85 were remitted to the City.
Report of the Acting Alderman Shockley was accepted as read. A check in the amount of $34.40 was remitted to the City.
Report of the Fire Recorder, Robbins Hose Co., for April was accepted as read.
Report of the Chief of Police was accepted as read.
Report of Cash Receipts for May was accepted as read.
FARM LAND
W. L. Harris appealed to the Hearing Committee for action be Council to have farm land within the City included on Tax Rolls. The matter was referred to the Legislative Committee to study and report its recommendation to Council.
LULU JAMES
Mrs. Lulu James, operator of a restaurant and tap room on Governors Avenue was arrested by City Police on charges of permitting a minor in a tap room and serving beer to a minor. When arrested she was photographed and fingerprinted. She appealed to Council to have her photograph and prints removed from the Police file and to have repealed the City ordinance under which she was arrested. A group of local tap room operators petitioned Council to retain the ordinance. On motion of Mr. Mundy, seconded by Mr. Hayes, Council directed that a letter be sent to Mrs. James advising her that Council cannot accede to her requests, and advising her that an appeal to a higher court is possible if she feels that injustice has been done to her.
ORDINANCE
On motion of Mr. Holpp, seconded by Mr. Mundy, the City Solicitor was directed to prepare an amendment to the ordinance prohibiting the presence of minors on tap rooms, to eliminate reference to it as an emergency measure.
A & P DRIVE WAY
M. Hayes Wilson requested permission to widen the driveway entering the A & P Parking lot from King Street. Council granted permission to widen the driveway, but directed that concrete sidewalks be installed and the small abandoned driveway be curbed.
GRANGE TAXES
The Capital Grange requested some abatement of their tax bill for 1956 which amounted to $257.40, outlining in their request their main civic activities and donations to the community. In previous years their tax bill amounted to $100. The matter was tabled until members of Council could discuss it further with representatives of the Grange.
SCANLON BEAUTY PARLOR
A letter from J. E. Leo Scanlon stated he had rented his property at 56 S. Governors Avenue to parties who propose to open a beauty parlor. The property is located in a residential section of the City. Council directed that the request be duly advertised.
LATEX PARKING
International Latex Corporation requested that the City prohibit parking on King’s Highway near its parking lot where parking by its employees obstructs the entrance of trucks loading and unloading. The Chief of Police will determine the area where parking will be prohibited and check with the State Highway Department. On motion of Mr. Davis, seconded by Mr. Biddle, the City Solicitor will prepare an ordinance based on the report of the Chief of Police.
NEW STREET CONDEMNATION
City Solicitor Hughes reported that condemnation proceedings had been started against the Bush and Matthews properties for the New Street right-of-way. He asked Council for instructions as to the amount of bond to be posted to secure immediate possession. On motion of Mr. Hayes, seconded by Mr. Holpp, Council directed that the amount to be posted for each parcel of land should be $50.00.
REPORT
Report of the City Manager was accepted as read.
WATER STREET RIGHT OF WAY
City Manger Ward reported that in a letter dated June 6, 1956 he made in writing Council’s offer of up to $1000 for a strip of land to be purchased from William Bradford for right-of-way on Water Street east of State Street. On motion of Mr. Zartman, seconded by Mr. Biddle, the City Manager was directed to again contact Mr. Bradford personally to see of the offer is acceptable to him. If it is not, or no reply is given, the offer is withdrawn, in which event the City Solicitor shall proceed forthwith to condemn the land required for right-of-way, and post a bond of $100 to obtain immediate possession.
SEWER PROGRAM
City Manager ward read to Council a letter from Albright & Friel Consulting Engineers, regarding sewers in Dover. Council discussed in particular the sewer problem on southwest Dover. Mr. Ward reported that a representative of Albright & Friel will be in Dover Thursday, June 14. No action will be taken until further discussion is had at that time.
UTILITY COMMITTEE
Councilman Holpp reported the Utility Committee had been considering a revision of electric rates and will bring its recommendations to Council at a later date.
