REGULAR MEETING
June 22, 1964
The Regular Meeting of City Council was held Monday, June 22, 1964 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hayes, Holpp, Hughes, Massey and Smith.
The invocation was said by Rev. McKim of the Presbyterian Church.
MINUTES
Minutes of the meeting of June 8, 1964 were accepted and bore the written approval of Mayor Carroll.
TV ANTENNA SERVICE
Council has approved an agreement between Delaware Teleservice (CATV) and the City of Dover for the operation of a TV antenna service and use of City of Dover electric poles. That Company asked for a change in a clause of the agreement which stated that their rates were subject to approval of City Council. They asked that they be required only to submit a copy of their rates to the City. Members of Council agreed that approval of the rates was not necessary. On motion of Mr. Harris, seconded by Mr. Massey, Council authorized the change in the agreement to eliminate requiring approval of rates and substituting submission of rates.
ELECTRIC DEPARTMENT BUDGET HEARING
In accordance with Section 505 of a Resolution adopted by City Council May 9, 1960 authorizing and securing the issue of Electric Revenue Bonds, a public hearing was advertised for this date on the budget for current expenses of the Electric System for the fiscal year beginning July 1, 1964. Mayor Carroll declared the hearing opened. No one appeared to speak for or against the proposed budget. A report was received from the Engineering Consultant’s, Gilbert Associates, Inc., which indicated approval of the proposed budget. No other testimony being offered, Mayor Carroll declared the hearing closed.
ELECTRIC DEPARTMENT BUDGET
On motion of Mr. Holpp, seconded by Mr. Hayes, Council by unanimous vote adopted the following Electric Department budget ordinance:
Be It Ordained By The Council Of The City of Dover:
Section 1. The amounts hereinafter named, aggregating Three Million, one hundred eleven thousand, one hundred twenty-nine dollars and Thirty-right cents ($3,111,129.38), or so much thereof as may be necessary, are hereby appropriated from current revenues of the Electric Department, now estimated to be Three Million, one hundred and twenty-eight thousand Dollars ($3,128,000.00), for the use of the several divisions of the Electric Department, and for the purposes hereinafter mentioned, for the Fiscal Year beginning July 1, 1964 and ending June 30, 1965, as follows:

Section 2. The City Manager is hereby authorized, without further approval of City Council, to make interdivisional transfers of up to 10% of the amount herein appropriated to any division, except that the amounts herein appropriated for interest, principal and reserve for 1960 Revenue Bonds and for the Electric Improvement Fund may not be decreased.

PARKS COMMITTEE
Councilman Smith submitted to Council a written report of a trip to Salisbury made by the Parks and Playgrounds Committee to inspect the park area in that City.
WAGES & HOURS
Councilman Hayes submitted to Council a written report of the meeting of the Wages & Hours Committee held on June 17 which was primarily concerned with a Capital Improvement Program. Mr. Hayes pointed out that it will be necessary to hold public hearings prior to the installation of curbs to be charged against property owners on any streets which are to be rebuilt. The report was accepted by Council.
PARK DRIVE AND SLAUGHTER STREET CURB
Council considered the installation of curbs and gutters on Park Drive, Minima, Clarence and Slaughter Streets in the City of Dover and public hearings thereon.
On motion of Mr. Hayes, seconded by Mr. Biggs, Council by unanimous vote adopted the following Resolution:
A RESOLUTION SETTING A PUBLIC HEARING TO CONSIDER THE INSTALLATION OF CURB AND GUTTER ON PARK DRIVE WITHIN THE CITY OF DOVER.
WHEREAS, the City Council of the City of Dover is considering the installation of concrete curb and gutter on both sides of Park Drive between Division Street and Loockerman Street and charging the cost thereof to property owners, and
WHEREAS, the Charter of the City of Dover requires that a public hearing be held prior to such action at which the property owners concerned may be heard and that notice of such hearing be published.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
Section 1. The Council of the City of Dover will hold a public hearing in the Council Chambers at City Hall at 8:15 P.M. July 13, 1964 on the question of installing concrete curb and gutters on both sides of Park Drive between Division Street and Loockerman Street and assessing the cost thereof to the property owners.
Section 2. The following-names persons are the owners or the purported owners of the properties in front of which the concrete curb and gutter will be installed.

BLOCK PARTY
Residents of Capital Green requested permission to hold a block party on Sussex Avenue between River Road and New Castle Avenue from 8 to 12 P.M. on July 4, 1964. Chief of Police Turner stated he had no objection to the request and that the area would be periodically checked. On motion of Mr. Hughes, seconded by Mr. Holpp, the request was granted.
PEOPLE TO PEOPLE
Mayor Carroll reported that Dover had been cited for its participation in the People to People program with Lamia, Greece.
WALKER ROAD ZONING HEARING
A public hearing was duly advertised for this date on a request of C. Lockwood Gooden to rezone a plot of land immediately north of Walker Road and adjoining the Pennsylvania Railroad from R-20 to C-4 use. Mayor Carroll declared the hearing opened. A letter from Ernest V. Keith on behalf of Mr. Gooden urged rezoning to commercial use of the land which Mr. Gooden desires to sell to Preston Trucking Co. for use as a trucking terminal. A letter from the Dover Special School District objected to rezoning the land because of the extra truck traffic which would be generated near the site of the new high school. A petition from residents of Northwest Dover Heights objected to the rezoning on the grounds that it would reflect on the general order, welfare, value and general atmosphere of all home owners in the area. C. Lockwood Gooden, speaking for himself, stated that property to the east and south were in commercial use and he could not see how his property could be anything but commercial, and that the trucking company proposed to build an attractive terminal. Council has asked the Dover Planning Commission to recommend zoning for the entire area but no report has as yet been received. Mr. Gooden stated he could not wait and asked for an immediate answer.
All who were present, including a group of citizens from Northwest Dover Heights, were given the opportunity to be heard. The hearing was closed.
Mayor Carroll asked if Council desired to take action. Councilman Hayes noted the demand of Mr. Gooden for immediate action. On motion of Mr. Hayes, seconded by Mr. Smith, Council denied the request of C. Lockwood Gooden to rezone a plot of land at Walker Road an the Railroad from R-20 use to C-4 use.
641 E. DIVISION ZONING
A public hearing was duly advertised for this date on a request of Gerald V. Mayan to rezone a plot of land at 641 E. Division Street from R-8 use to RG-2 use. Mayor Carroll declared the hearing open. Mr. Mayan desires to convert a residence at the location into offices for two doctors. The request had been referred to the Planning Commission, who recommended approval. Mr. Robert Tudor, a nearby property owner, objected to the rezoning on the grounds that approval would result in other businesses or offices being established in what is now a residential area. Mr. Tudor mentioned the plan of the State Highway Department to reconstruct East Division Street. It was noted that the plot in question was large enough to provide off street parking. No other witnesses appeared to testify and the hearing was closed.
On motion of Mr. Hughes, seconded by Mr. Hayes, Council by vote of 5 to 2 passed the following ordinance. Messrs. Biggs and Smith voted ‘No’.
AN ORDINANCE AMENDING THE ZONING MAP AND ZONING ORDINANCE OF THE CITY OF DOVER BY CHANGING THE ZONING DESIGNATION OF AN AREA ON E. DIVISION STREET FROM R-8 TO RG-2 USE.
WHEREAS, the City of Dover has enacted a zoning ordinance regulating the use of property within the limits of the City of Dover, and
WHEREAS, it is deemed in the best interest of zoning and planning to change the permitted uses from R-8 to RG-2 in a plot located at the northwest corner of E. Division Street and Edgehill Avenue, known as 641 E. Division Street,
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER:
1. From and after the passage and approval of this ordinance, the Zoning Map and Zoning Ordinance of the City of Dover shall be amended by changing the zoning designation from R-8 to RG-2 use that plot of land located at 641 E. Division Street in the City of Dover measuring approximately 140' x 170'.

CURBS SLAUGHTER STREET AREA
On motion of Mr. Hayes, seconded by Mr. Biggs, Council by unanimous vote adopted the following Resolution:

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

AMA CONGRESS
A letter from the American Municipal Association invited officials from the City of Dover to attend their Congress to be held at Miami Beach July 25 to 29. Mayor Carroll reported he had been appointed to a committee by the Association and plans to attend with his wife.
