REGULAR MEETING
June 13, 1966
The Regular Meeting of City Council was held Monday, June 13, 1966 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hastings, Hayes, Holpp, Hughes, Jackson and Smith.
The invocation was said by the Rev. Samuel A. Snyder.
MINUTES
Minutes of the meeting of May 23, 1966 were accepted and bore the written approval of Mayor Carroll.
REPORTS
Report of the Chief of Police was accepted.
Report of the Acting Alderman was accepted. Fines in the amount of $317.80 had been remitted to the City.
Report of the Fire Marshal and Building Inspector was accepted.
Report of Cash Receipts, General Fund, was accepted.
Budget Report, General Fund, was accepted.
Cash Report, Electric Revenue Fund, was accepted.
Cash Report, Electric Improvement Fund, was accepted.
Report of the City Manager was accepted.
TRAILERS
Councilman Hughes referred to the question of trailers and whether the provisions of the Zoning Ordinance were to be enforced requiring their removal from the City. Mayor Carroll noted that the question had been referred to a committee consisting of the various chairmen of the committees of Council.
GRASS ORDINANCE
An ordinance was presented for the consideration of Council providing penalties for failure to cut grass and weeds within the City. On motion of Mr. Hayes, seconded by Mr. Jackson, Council directed that the ordinance be published in the local newspaper once each week for the next two weeks and considered by Council at its next meeting.
CHAMBER SIGN
The Chamber of Commerce requested permission to erect a sign in the triangle at the intersection of Forrest Street and Division Street. On motion of Mr. Hayes, seconded by Mr. Holpp, the request was referred to the State Highway Department and the Chief of Police.
CATTS ZONING HEARING
A public hearing had been duly advertised for this date on a request by Mrs. Della V. Catts to rezone a property at New and Cecil streets from RG-1 to C-1. Mayor Carroll declared the hearing opened. Andrew Couhig, relator and agent for Mrs. Catts, spoke to Council and pointed out that the property had originally been a store but had not been used as such for several years so that the use was no longer permitted under the Zoning Ordinance. Mrs. Catts wishes to sell the property for commercial use. The Planning Commission has recommended approval of the zoning change. No one spoke against the request. Mayor Carroll declared the hearing closed.
On motion of Mr. Smith, seconded by Mr. Hayes, Council by unanimous vote passed the following ordinance:
AN ORDINANCE AMENDING THE ZONING MAP AND ZONING ORDINANCE OF THE CITY OF DOVER BY CHANGING THE ZONING DESIGNATION OF A PLOT AT NEW AND CECIL STREETS FROM RG-1 TO C-1 USE.
WHEREAS, the City of Dover has enacted a zoning ordinance regulating the use of property within the limits of The City of Dover, and
WHEREAS, it is deemed in the best interest of zoning and planning to change the permitted use from RG-1 to C-1 in the area described below
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
Section 1. From and after the passage and approval of this ordinance, the Zoning Map and Zoning Ordinance of The City of Dover shall be amended by changing the zoning designation from RG-1 to C-1 use on that plot located on the northwest corner of New and Cecil Streets measuring approximately 26' on New Street and 145' on Cecil Street, now or formerly the property of Mrs. Della V. Catts.

WYOMING AVENUE CURBS
A public hearing has been duly advertised for this date on a proposal of City Council to install curb and gutter on both sides of Wyoming Avenue from Governors Avenue to New Burton Road and to change the cost thereof to property owners. Mayor Carroll declared the hearing opened. James Maloney spoke for certain property owners on Wyoming Avenue who now have curb installed in front of their property and who were concerned about cost which might be assessed to them. Mayor Carroll explained the policy of the City was not to assess any cost to such properties even though it was sometimes necessary to replace existing curb. Gustav Konschak objected to the curb installation and assessment of cost because he has about 1200 feet of frontage and he says he doesn’t need the curbing. He thinks it would also be necessary to relocate electric poles on his property and shrubbery or hedge. He was not certain where his property line was located but apparently thought it included part of the street right of way. He also operates a produce stand and stated that construction during the summer would cause him to lose business. City Engineer Joseph stated that curing his property could be scheduled last in the construction project which would not reach Konschak’s property until after the middle of August. C. F. Schwartz, Robert A. Schwartz and Howard C. Turner objected by letter to the curb installation and assessing of costs. Councilman Hughes questioned whether the cost of curbing could be assessed against farm land. Mayor Carroll noted it had been done before. Eugene P. Werner asked that truck traffic and speeding be controlled if and when the street is improved. All were given an opportunity to speak. Mayor Carroll declared the hearing closed.
On motion of Mr. Harris, seconded by Mr. Hayes, Council by vote of 7 to 1 adopted the following resolution. Mr. Hughes voted ‘No’.
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CONCRETE CURB AND GUTTER ON BOTH SIDES OF WYOMING AVENUE BETWEEN GOVERNORS AVENUE AND NEW BURTON ROAD.
WHEREAS, the Mayor and Council of The City of Dover have considered the installation of concrete curb and gutter on the streets mentioned above and assessing the cost thereof to property owners, and
WHEREAS, a public hearing has ben held by the Mayor and Council to determine whether the said curb and gutter should be installed, and
WHEREAS, pursuant to the hearing the Mayor and Council have determined that such installation is for the best interest of the residents of the above area,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install concrete curb and gutter along both sides of Wyoming Avenue between Governors Avenue and New Burton Road.
2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage each property owner has on the aforesaid streets, except that no charge shall be made to those property owners in front of whose property curb and gutter is already installed.

SLAUGHTER STREET CURB
A public hearing has been duly advertised for this date on a proposal of City Council to install curb and gutter on both sides of Slaughter Street between North and Loockerman Streets and assessing the cost thereof to property owners. Mayor Carroll declared the hearing opened. No one appeared to speak for or against the proposal. Mayor Carroll declared the hearing closed.
On motion of Mr. Hayes, seconded by Mr. Jackson, Council by unanimous vote adopted the following resolution:

WHEREAS, a public hearing has been held by the Mayor and Council to determine whether the said concrete curb and gutter should be installed, and
WHEREAS, pursuant to the hearing the Mayor and Council have determined that such installation is for the best interest of the residents of the above area
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install concrete curb and gutter along both sides of Slaughter Street between North Street and Loockerman Street.
2. That the cost of installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage each property owner has on the aforesaid street, except that no charge shall be made to those property owners in front of whose property curb and gutter is now installed.

LINCOLN STREET CURB
A public hearing has been duly advertised for this date on a proposal of City Council to install curb and gutter on both sides of Lincoln Street between Forrest Street and Gibbs Drive and assessing the cost thereof to property owners. Mayor Carroll declared the hearing opened. No one appeared to speak for or against the proposal. A resident asked about a ditch which will be closed in the process of constructing the street. Mayor Carroll declared the hearing closed.
On motion of Mr. Holpp, seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CONCRETE CURB AND GUTTER ON BOTH SIDES OF LINCOLN STREET BETWEEN FORREST STREET AND GIBBS DRIVE.
WHEREAS, the Mayor and Council of The City of Dover have considered the installation of concrete curb and gutter on the street mentioned above and assessing the cost thereof to property owners, and
WHEREAS, a public hearing has been held by the Mayor and Council to determine whether the said concrete curb and gutter should be installed, and
WHEREAS, pursuant to the hearing the Mayor and Council have determined that such installation is for the best interest of the residents of the above area
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install concrete curb and gutter along both sides of Lincoln Street between Forrest Street and Gibbs Drive.
2. That the cost of installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage each property owner has on the aforesaid street, except that no charge shall be made to those property owners in front of whose property curb and gutter is now installed.

TOWNE POINT PARK
City Manager Ward reported that an agreement had been reached which provides for a temporary entrance to the park lands located in the Towne Point development.
RATE STUDY
City Manager Ward reported that estimates of cost of rate studies for electricity had been received from two consulting firms who specialize in such work. One estimate of cost is approximately $12,000 the second is $3500 and was received from Middle West Service Company. Mr. Ward recommended acceptance of the latter offer. On motion of Mr. Hastings, seconded by Mr. Harris, Council authorized the City Manager to complete an agreement with Middle West Service Company to complete a study and make recommendations for rates to be established for domestic, heating, general service and industrial electric rates.
SEWAGE PLANT
Preliminary reports were received from Robert L. Smith, Superintendent of the Sewage Treatment Plant, and from Albright & Friel, Engineering Consultants on tests and evaluations made on the enlarged sewage treatment plant. Council discussed the reports with City Manager Ward, Jack Woods, Robert L. Smith and Robert W. Neeson of Albright & Friel. Mr. Neeson stated that 60 or 90 days will be required before submission of a final report and recommendations.
QUEEN STREET EXTENSION
The State Highway Department proposes to construct an extension of Queen Street south from Water Street to connect with New Burton Road at approximately Dover Street. An agreement between the State Highway Department and City of Dover was presented for approval of City Council which contained, among others, a provision that the City of Dover would pay up to 25% of the cost of acquiring right-of-way, but not to exceed $13,000. On motion of Mr. Hayes, seconded by Mr. Harris, Council approved the agreement and authorized its completion.
ELECTRIC DEPARTMENT BUDGET
A public hearing has been duly advertised for this date on the preliminary budget of current expenses of the electric system for the Fiscal Year beginning July 1, 1966. Mayor Carroll declared the hearing opened. No one appeared to speak for or against the proposed budget. Mayor Carroll declared the hearing closed.
On motion of Mr. Holpp, seconded by Mr. Biggs, Council by unanimous vote passed the following ordinance:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER:
Section 1. The amounts hereinafter named, aggregating Three million, six hundred ninety thousand, three hundred sixty-three dollars and thirteen cents ($3,690,363.13), or so much thereof as may be necessary, are hereby appropriated from current revenues of the Electric Department, now estimated to be Three Million, seven hundred seventy-seven thousand Dollars ($3,777,000.00), for the use of the several divisions of the Electric Department, and for the purposes hereinafter mentioned, for the Fiscal Year beginning July 1, 1966, and ending June 30, 1967, as follows:

Section 2. The City Manager is hereby authorized, without further approval of City Council, to make interdivisional transfer of up to 10% of the amount herein appropriated to any division, except that the amounts herein appropriated for interest, principal and reserve for 1965 Revenue Bonds, and for the Electric Improvement Fund, may not be decreased.

Council considered the budget for the operation of the general departments of the City for the Fiscal Year beginning July 1, 1966. On motion of Mr. Harris, seconded by Mr. Holpp, Council by unanimous vote adopted the following budget ordinance:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
Section 1. The amounts hereinafter named, aggregating One Million, Six hundred nineteen thousand, thirty-five Dollars and sixty-two cents ($1,619,035.62), or so much as may be necessary, are hereby appropriated from current revenues and other funds for the use of the several departments of the Municipal Government, and for the purposes hereinafter mentioned, for the Fiscal Year beginning July 1, 1966 and ending June 30, 1967, as follows:

AUDITOR
Appointment of a firm to audit the accounts of the City was tabled until the next regular meeting of Council.
SAFETY COMMITTEE
Councilman Smith submitted a written report of a meeting of the Safety Advisory Committee held June 6, 1966, which was accepted by Council.
The Committee recommended the purchase of 10 ‘No Left Turn’ signs for use on Loockerman Street to be controlled by the traffic synchronization system at a price of approximately $3000. On motion of Mr. Holpp, seconded by Mr. Smith, Council authorized the purchase of the signs by vote of 7 to 1, Mr. Hayes voting ‘No’.
The committee recommended that an ordinance be prepared to prohibit the parking of abandoned or junked vehicles within the City. On motion of Mr. Jackson, seconded by Mr. Smith, The Solicitor was directed to prepare such an ordinance.
Councilman Jackson urged that action be taken to require the repair of sidewalks within the City.
PARKS COMMITTEE
Councilman Smith submitted a written report of a meeting of the Parks, Playgrounds and Tree Committee held June 6, 1966, which was accepted by Council.
UTILITY COMMITTEE
Councilman Holpp submitted a written report of a meeting of the Utility Committee held June 10, 1966, which was accepted by Council.
VICTORY CHAPEL
Pastor James T. Jones of Victory Chapel requested permission to erect a tent on lands of Ralph Spence on S. New Street to conduct religious services from June 15 thru June 26, 1966. On motion of Mr. Hayes, seconded by Mr. Hastings, the request was referred to the Chief of Police and Fire Marshal for disposition.
POLICE
Chief of Police Turner reported on the attendance of Mayor Carroll and himself at the graduation of William Spence from the Traffic Institute at Northwestern University.
Chief Turner also reported that plans on the new police station should be ready for submission to bidder early in July.
