REGULAR MEETING
April 10, 1972
The regular meeting of City Council was held on Monday, April 10, 1972 at 7:30 P.M. with Mayor Carroll presiding. Members present were Messrs Biggs, Harris, Hayes, Holmes, Holpp, Legates, Muir and Walls.
The invocation was said by the Rev. Eldon Fowler of the Capital Baptist Church.
MINUTES
The minutes of the City Council meeting of March 27, 1972 were accepted and bore the written approval of Mayor Carroll.
REPORTS
Chief of Police report for the month of March was accepted.
Building Inspector & Fire Marshal report for the month of March was accepted.
City Planner report for the month of March was accepted.
Alderman report for the month of March was accepted, fines in the amount of $1,009 were remitted.
Cash Receipts, General Fund, for the month of March were accepted.
Budget Report, General Fund, for the month of February was accepted.
Cash Receipts, Electric Revenue Fund, for the month of March were accepted.
Cash Receipts, Electric Improvement Fund, for the month of March were accepted.
City Manager report for the month of March was accepted.
BAYARD AVENUE FENCE
The Building Inspector has requested of Council a directive concerning the fence and steps located at the south end of Bayard Avenue where it dead-ends with the City of Dover property known as the Little League Park. The residents have requested permission to erect a planter, fence and steps at this dead-end street. On motion of Mr. Legates, seconded by Mr. Muir Council directed that the City Manager and Building Inspector meet with the residents for approval of the installation of the fence and the construction of the steps at this location mentioned above.
ELECTRIC METER ORDINANCE
On motion of Mr. Hayes, seconded by Mr. Walls, Council by a unanimous roll call vote adopted the following ordinance amending the City of Dover Code, Section 12-44.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
That Section 12-44 of the Dover Municipal Code is hereby amended by adding a new subsection to the same to be known as subsection (c);
Section 12-44(c) - Customer’s responsibility to make meters available for reading; All customers utilizing electricity furnished by the City shall make their electric meters available at reasonable times for immediate reading and inspection by employees of the City. It shall be unlawful and a violation of this code for any person who is a customer of City electricity to fail or refuse to make the meter on his property or upon property leased or rented by him immediately available for inspection and reading by employees of the City of Dover.

GRASS CUTTING ORDINANCE
A recommendation has been received from the Building Inspector’s Office for the amendment of the Grass Cutting Ordinance that would amend section 30-7 of the Dover Municipal Code. Prior to the adoption of this Ordinance amending the Code a public hearing will be held. On motion of Mr. Harris, seconded by Mr. Biggs, Council directed that a public hearing be held on April 24, 1972 at 8:00 P.M. and that a copy of this ordinance be published in the Delaware State News prior to the public hearing.
UNIT #3 BIDS
Bids were received on March 29, 1972 on 22KV Power Transformers for Unit #3, McKee Run Station. Five bids were received with the low bid being that of McGraw-Edison at a price of $215,000. The Engineer’s estimate for this project was $240,000. On motion of Mr. Holpp, seconded by Mr. Hayes, Council by unanimous roll call vote awarded that above contract to the low bidder, McGraw-Edison, at the bid price of $215,000.
Bids were also received on March 29, 1972 on 22KV Oil Circuit Breakers. Three bids were received with the low bidder being Westinghouse Corporation at a bid price of $61,928. The Engineer’s estimate was $67,000. On motion of Mr. Holpp, seconded by Mr. Hayes, Council by unanimous roll call vote awarded the above contract to the low bidder, Westinghouse Corporation at the bid price of $61,928.
SIDEWALK ASSESSMENTS
A public hearing was duly advertised for this time and place to consider the assessment cost of the installation of sidewalk in the area bounded by Governors Avenue, Williams Street, Division Street, and the Railroad. Mayor Carroll declared the hearing opened. No one was present to speak for or against the assessment. The recommendation for the levy and assessment is at the rate of $.60 per square foot of sidewalk installed. Mayor Carroll declared the hearing closed. On motion of Mr. Walls, seconded by Mr. Muir, Council by unanimous roll call vote approved the recommendation in setting the levy and assessment of sidewalks at $.60 per square foot and the method of payment as outlined in the ordinance adopted by City Council on March 13, 1972.
SEWER AND WATER ASSESSMENTS
A public hearing was duly advertised for this time and place to consider the assessment cost of the installation of sewer and water lines installed under Project Number 44 and 48. Mayor Carroll declared the hearing opened. No one was present to speak for or against the assessment. The Utility Committee has recommended that an assessment of $4.00 per front foot on the installation of water lines and $6.00 per front foot on the installation of sewer lines. Mayor Carroll declared the hearing closed. On motion of mr. Muir, seconded by Mr. Biggs, Council by unanimous roll call vote approved the recommendation of the Utility Committee on the cost per front foot of the installation of water and sewer lines installed under Project Numbers 44 and 48 and the method of payment as outlined in the ordinance adopted by City Council on March 13, 1972.
FAIRVIEW DEVELOPMENT REZONING
A public hearing was duly advertised for this time and place to consider the rezoning of five lots located in the Fairview Development from C-1 to R-8. Mayor Carroll declared the hearing opened. Mr. Dennis O’Brien, owner of three of these lots, was present and addressed Council requesting that these lots remain under the commercial zoning. Mrs. O’Brien was also present and spoke on behalf of their remaining commercial. Several of the area residents were present and spoke on behalf of having these lots rezoned to residential. The Planning Commission has recommended they be rezoned to R-8. Mayor Carroll declared the hearing closed. On motion of Mr. Muir, seconded by Mr. Holmes, Council by unanimous roll call vote adopted the following ordinance.
AN ORDINANCE AMENDING THE ZONING ORDINANCE AND ZONING MAP OF THE CITY OF DOVER BY CHANGING THE ZONING DESIGNATION OF THE PROPERTY LOCATED IN FAIRVIEW DEVELOPMENT, LOTS 10, 11, 32, 33, and 34 FROM C-1 TO R-8 USE.
WHEREAS, The City of Dover has enacted a zoning ordinance regulating the use of property within the limits of the City of Dover, and
WHEREAS, it is deemed in the best interest of zoning and planning to change the permitted use from C-1 to R-8 on the property described below.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. That from and after the passage and approval of this ordinance, the Zoning Ordinance and Zoning Map of the City of Dover shall be amended to change the zoning designation of Lots 10, 11, 32, 33 and 34 in Fairview Development located between Carol and Fairview Avenues and north of Columbia Avenue from C-1 to R-8. Lots 10 and 11 being owned by Frank Robino, Inc. and lots 32, 33 and 34 being owned by Dennis O’Brien.

BULLOCK REZONING
A public hearing was duly advertised for this time and place to consider the rezoning of the property located on the northeast corner of Wyoming Avenue and Bradford Street. Mayor Carroll declared the hearing opened. Dr. James Gallagher, equitable owner, was present and spoke on behalf of the rezoning. No one else was present to speak for or against the rezoning. The Planning Commission has recommended approval of this request. Mayor Carroll declared the hearing closed. On motion of Mr. Holpp, seconded by Mr. Harris, Council by a roll call vote of 7 ‘yes’ and 1 ‘no’, Mr. Holmes, adopted the following ordinance.
AN ORDINANCE AMENDING THE ZONING ORDINANCE AND ZONING MAP OF THE CITY OF DOVER BY CHANGING THE ZONING DESIGNATION OF THE PROPERTY LOCATED ON THE NORTHEAST CORNER OF WYOMING AVENUE AND BRADFORD STREET FROM RG-1 TO RG0 USE.
WHEREAS, The City of Dover has enacted a zoning ordinance regulating the use of property within the limits of the City of Dover, and
WHEREAS, it is deemed in the best interest of zoning and planning to change the permitted use from RG-1 to RG0 on the property described below.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. That from and after the passage and approval of this ordinance, the Zoning Ordinance and Zoning Map of the City of Dover shall be amended to change the zoning designation of the property being owned by the Arlington Bullock Estate, equitable owner being Dr. James Gallagher, and containing approximately 27,000 square feet.

VETTER REZONING
A public hearing was duly advertised for this time and place to consider the rezoning of the property located on Ross Street between State Street and Governors Avenue. Mayor Carroll declared the hearing opened. Mr. Fred Vetter, the owner of this property, was present and addressed Council. The original request submitted was to rezone this property from R-10 to R-7. Mr. Vetter at this time was requesting that this be changed to R-8. This could be done at this hearing by virtue of the fact that R-8 rezoning is more restrictive than R-7. The Planning Commission, acting on the R-7 request, recommended that the rezoning be denied, feeling there wasn’t enough land area for R-7 zoning in the plot. No one else was present to speak for or against the rezoning. Mayor Carroll declared the hearing closed. On motion of Mr. Muir, seconded by Mr. Biggs, Council by unanimous roll call vote adopted the following ordinance.
AN ORDINANCE AMENDING THE ZONING ORDINANCE AND ZONING MAP OF THE CITY OF DOVER BY CHANGING THE ZONING DESIGNATION OF THE PROPERTY LOCATED ON ROSS STREET BETWEEN STATE STREET AND GOVERNORS AVENUE FROM R-10 TO R-8 USE.
WHEREAS, The City of Dover has enacted a zoning ordinance regulating the use of property within the limits of the City of Dover, and
WHEREAS, it is deemed in the best interest of zoning and planning to change the permitted use from R-10 to R-8 on that property described below.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. That from and after passage and approval of this ordinance, the Zoning Ordinance and Zoning Map of the City of Dover shall be amended to change the zoning designation of the property located on Ross Street between State Street and Governors Avenue from R-10 to R-8, this property being owned by Fred W. Vetter and containing approximately 31,800 square feet.

HENRY HELLER REQUEST
Another request has been received from Mr. Henry Heller to annex property within the limits of the City of Dover that he owns located on the southside of the Hartly Road. On motion of Mr. Hayes, seconded by Mr. Muir, Council referred this request to the Utility Committee for their study and recommendation.
EDGELL CONSTRUCTION CO. DONATION
A letter was received from Mr. Louis Edgell, President of Edgell Construction Company the owner of a plot of land located at 11 and 15 Kirkwood Street that he wishes to donate to the City of Dover. This land is presently being used as a playground by the City of Dover. He expressed a desire to donate this land to be used for whatever purpose the City officials deem fit and proper. His only request was that all attorney’s fees, transfer taxes and other expenses be borne by the City. On motion of Mr. Harris, seconded by Mr. Walls, Council accepted the offer of Mr. Louis Edgell and directed that the necessary papers be drawn to execute the transfer of this property.
DOWNTOWN DOVER SCALE MODEL
A scale model panorama of Dover in the downtown business district was made some years ago for the Urban Renewal project of Loockerman Street. The Downtown Dover Business Assn. has formed a committee to work on a project of renewal of Loockerman Street. They have requested permission to use the panorama that the City has and will display it in the downtown area. On motion of Mr. Hayes, seconded by Mr. Walls, Council granted permission for this panorama to be used by the DDBA.
MORTON R. KIMMEL CORRESPONDENCE
A letter was received from Morton R. Kimmel, Deputy Administrator of the Chief Justice of the State of Delaware, stating that work is being done by his department to draft legislation that would enable the Department of Motor Vehicles to impound vehicles and suspend driving privileges for all persons that owe the State of Delaware and the Local Municipalities money under the deferred fines system. On motion of Mr. Walls, seconded by Mr. Muir, Council referred this correspondence to the Legislative & Finance Committee for their study and recommendation.
GARDEN CLUB
A request was received from the Dover Garden Club on behalf of the State Garden Clubs to proclaim the City of Dover as a bird sanctuary, and permit the Dover Garden Club to post signs so stating this. On motion of Mr. Muir, seconded by Mr. Walls, Council adopted the following resolution.
BIRD SANCTUARY RESOLUTION
WHEREAS, we realize that special effort must be made to preserve bird life in our community, and
WHEREAS, birds give beauty and charm as well as their economic value.
NOW, THEREFORE, I, CRAWFORD J. CARROLL, MAYOR OF DOVER, DELAWARE, do hereby proclaim the City of Dover, Delaware to be a municipal bird sanctuary, and do call upon the people of Dover, Delaware to protect birds from stray dogs, cats, unlawful shooting and to replant berry-bearing trees and shrubs for food and shelter.

CARLISLE LAND INC.
A request was received from Carlisle Land Inc. to rezone land they own located on Walker Road Extended. A public hearing is required prior to amending the Zoning Ordinance and Zoning Map. On motion of Mr. Legates, seconded by Mr. Walls, Council adopted the following resolution and referred the request to the Planning Commission.
A RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP AND DIRECTING THAT NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.
WHEREAS, certain property located on Walker Road extended is presently zoned for RG-3 use, and
WHEREAS, it is necessary to hold a public hearing prior to amending the Zoning Map and Ordinance.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That a public hearing will be held in City Hall on May 8, 1972 at 8:00 P.M. on a proposed amendment to the Zoning Ordinance and Zoning Map of the City of Dover that would rezone from RG-3 to RG-2 that land located on the northside of Walker Road Extended, owned by Carlisle Land Inc., and containing approximately 15,000 square feet.
2. That notice of this public hearing be given in accordance with the provisions of the Delaware Code.

SIDEWALK RESOLUTION
A recommendation has been received to install sidewalks in an area of Dover where they do not now exist. On motion of Mr. Holmes, seconded by Mr. Harris, Council by unanimous vote adopted the following resolution.
A RESOLUTION SETTING A PUBLIC HEARING PERTAINING TO INSTALLATION OF SIDEWALKS IN CERTAIN AREAS OF THE CITY OF DOVER.
WHEREAS, certain sections of the City of Dover are without sidewalks, and
WHEREAS, the conditions of particular streets within the City require that sidewalks be installed for the safety, convenience and public welfare of the citizens of the City of Dover, and
WHEREAS, the Mayor and Council of the City of Dover are deliberating the feasibility of a comprehensive sidewalk installation program for the City of Dover.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. That a public hearing be held on Monday, May 8, 1972 at 8:00 P.M. in the Council Chambers of City Hall to consider the installation of sidewalks along the streets in the section of the City of Dover that include both sides of Greenhill Avenue from Park Drive to U.S. Route 13; and both sides of Bayard Avenue from Division Street to the City owned land, known as the Little League Park, where curbing is installed and assessing the cost thereof to property owners concerned.
2. That notice of the public hearing be given in at least one newspaper published in the City of Dover.

CURB & GUTTER RESOLUTION
A recommendation has been received to install concrete curb and gutters on Carver Road and the area of Eastlake Gardens. On motion of Mr. Holmes, seconded by Mr. Harris, Council by unanimous vote adopted the following resolution.
A RESOLUTION SETTING A PUBLIC HEARING TO CONSIDER THE INSTALLATION OF CURB AND GUTTER ON BOTH SIDES OF CARVER ROAD AND IN THE AREA OF EASTLAKE GARDENS.
WHEREAS, the City Council of the City of Dover is considering the installation of concrete curb and gutters on both sides of Carver Road, Lakeview Drive, Garden Lane, Silver Lake Drive, East Avenue and Sunset Street and charging the cost thereof to property owners, and
WHEREAS, the Charter of the City of Dover requires that a public hearing be held prior to such action, at which time the property owners concerned and other residents of the City may be heard, and that notice of such hearing be published.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. The Council of the City of Dover will hold of public hearing in the Council Chambers of City Hall at 8:00 P.M. on May 8, 1972 on the question of installation of concrete curb and gutters on both sides of Carver Road, Lakeview Drive, Garden Lane, Silver Lake Drive, East Avenue and Sunset Street and assessing the cost thereof to the property owners.

TAX APPEAL HEARINGS
A public hearing was duly advertised for this time and place to consider the Tax Appeals for the year of 1972. Mayor Carroll declared the hearing opened. A report of the Tax Appeals Committee was read at this time. Following the report, further appeals were made by property owners within the City of Dover. Mr. William Hudson, representing Realty Register Company, Dover Mart, and Devon Place Apartments, was present and asked for further consideration in the reduction of the assessments of these properties. Mr. Walter Barczewski, Professional Real Estate Appraiser, was present and also spoke on behalf of Mr. Hudson’s clients. A representative of Woodcrest Arms, Wedgewood Apartments and Dickson Arms Apartments was present and appealed to Council for a further reduction in these assessments. Mr. Barczewski spoke on behalf of these properties as to his professional opinion of their values. Mr. Thomas Kramedas, owner of the Hub Restaurant, Quality Court Motel South, and the Sunoco Station, all located on U.S. Route 13, appealed to Council for a further reduction in the assessment of these properties. Mr. Chester Carroll, representing Mrs. Edythe Carroll, 553 Woodsedge Road; Carroll Realty Company, corner of U.S. Route 13 and Roosevelt Avenue; and Carroll’s Corner Shopping Center, appealed to the Council for a further reduction in the assessment of these three properties. Mrs. Christina Meyer, owner of the Edgehill Shopping Center, appealed to Council for a further reduction in the assessment of this property. No one else was present to speak for or against the assessments. Mayor Carroll declared the hearing closed. On motion of Mr. Holpp, seconded by Mr. Harris, Council by unanimous roll call vote accepted the appraisal report and figures of the J. M. Cleminshaw Company, as per the contract awarded them for the reappraisal of the real property of the City of Dover, and further accepted the assessment report of the City of Dover Tax Assessor with the following recommendations of the Tax Appeals Committee.
