Friday evening July 8th, 1921.

Council met at 7:30 P. M. with the following members present, Burton, Caulk, Downes Bice, Hopkins, Keith and Magee, 7.

Meeting called to order by the President and on motion of Messrs. Caulk and Downes the reading of the minutes for June was dispensed with, on account of the extreme heat.

Aldermans Report: The Aldermans report for June showed 9 arrests and Fines amounting to $42.85 collected and cheque for this amount given the President for the Treasurer.

On motion of Messrs Bice and Downes the report was accepted and ordered filed.

Ordinance Committee: An ordinance relative to Gas tanks was presented and read by the Clerk of Council.

After discussion by members of Council, on motion of Messrs Bice and Keith the Ordinance after changes made was adopted by a yea and may vote as follows:

Ordinance as follows:

An Ordinance Regulating the Storage and use of Gasoline or Any Product of Petroleum, or any Hydro-Carbon Liquid Which Will Flash or Emit an Inflammable Vapor Below the Temperature of One Hundred and Ten (110) Degrees Fahrenheit. Within the Corporate Limits of The Town of Dover, Kent County, Delaware.

BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF DOVER AS FOLLOWS:

SECTION 1. No person, firm, association or corporation shall have, keep for sale, or store in any place or building within The Town of Dover any gasoline, naptha or any other volatile inflammable liquid or product under whatsoever name designated, unless the following regulations are complied with.

SECTION 2. “DEFINITIONS”. The term “Gasoline” wherever used herein shall mean any product of petroleum or any hydro-carbon liquid that will flash or emit an inflammable vapor below the temperature of one hundred and ten (110) degrees Fahrenheit.

                        A. “Approved”, shall mean approved by the Street Committee of The Town Council of The Town of Dover.

                        B. “Test”. The Street Committee of The Town council of The Town of Dover shall test and decide the flashing point or may employ a competent person to make such test and decide the flashing point.

                        C. “The Lowest Property Elevation” shall mean the lowest point in any excavation, cellar, cellarway, basement or street grade within thirty (30) feet of the location of a storage tank.

SECTION 3. “TOWN COUNCIL TO GRANT PERMITS”. It shall be unlawful for any person, firm, association or corporation hereafter to store or handle gasoline for their own requirements or for the purpose of sale, where more than one quart of gasoline is kept or stored, without first obtaining a permit therefor from The Town Council of The Town of Dover, specifying the name of the permittee, and the location of the premises where gasoline is stored or kept, and the amount of gasoline desired. PROVIDED, HOWEVER, that the provisions of this section shall not apply to gasoline stored in the tanks of automobiles, automobiles trucks or other motor vehicles, or to tanks now erected from which automobile gas tank trucks are filled.

SECTION 4. “APPLICATION FOR PERMIT”. Application for permit to store or keep gasoline shall be made in writing to The Town Council of The Town of Dover by the owner or owners or lessees of the real estate upon which gasoline is to be stored or kept, giving the description and location of the property, giving the name of the owner of the property, and of the lessee in case application is made by the latter, and it shall be approved by The Town Council of The Town of Dover before it shall be lawful for any gasoline to be stored or kept or any device for the storage and handling of gasoline maintained.

SECTION 5. “STREET COMMITTEE TO REPORT”. All applications for permit to store gasoline shall, before final action is taken thereon by The Town Council, be referred to the Street Committee of The Town Council of The Town of Dover for investigation and t report the conditions necessary to be embodied in the resolution granting such privileges to the petitioner. FURTHERMORE, the said Street Committee of the Town Council of The Town of Dover shall furnish each applicant with a written or printed copy of all the requirements imposed by this ordinance for their information and guidance as to the manner in which gasoline shall be stored.

SECTION 6. “STORAGE OF GASOLINE”. One approved five-gallon can of gasoline or gasoline kept in portable filling tanks, commonly called buggies, may be stored inside of a building or upon public or private property. No one approved portable filling tank or buggy shall contain more than fifty (50) gallons of gasoline; all said portable filling tanks or buggies shall be mounted on all metal wheels with rubber tires, each to be equipped with an approved pump fitted with hose attachment not to exceed eight (8) feet in length; fitted at the end with a ground shut off nozzle or with approved hose draining attachment and filling nozzle; the gasoline to be pumped into the reservoir of the automobile from the said approved portable filling tank or buggy.

All other methods of storing gasoline shall be as follows: All gasoline shall be stored in tanks outside of the walls of all buildings, under the sidewalk, next the street curb, in tanks constructed of not less than No. 14 galvanized steel, riveted, steel to steel joints, soldered and coated with tar or other rust resisting material, or in iron tanks of not less than three-sixteenth (3/16) of an inch in thickness, riveted, caulked, or welded, coated with tar or other rust resisting material.

No one tank shall contain more than one thousand sixty-five (1065) gallons of gasoline.

Not more than two (2) tanks are installed upon the same premises there shall be at least two (2) feet of space filled in with earth dividing each tank.

Not more than one storage tank of fifty (50) gallons capacity shall be allowed for any one private garage and the said storage tank shall not be installed without the consent of the Town Council of The Town of Dover.

A.  All storage tanks must be placed outside of the building, under the sidewalk, close to the curb line.

B.  No storage tank shall be placed under any sidewalk of The Town of Dover at a point nearer than fifty (50) feet to the intersection of any streets or nearer than twenty (20) feet to any fire hydrant.

C.  The top of all storage tanks must be at least three (3) feet below the Lowest Property Elevation, within thirty (30) feet of such storage tank. The space between the top of the tank and the sidewalks shall be filled with earth.

D.  Where the sidewalk is excavated and used as a part of a basement or where it is impracticable to bury a storage tank below the Lowest Property Elevation within thirty (30) feet, the bottom of tanks may be placed on same elevation as basement and a concrete receptacle or box, the bottom, sides and ends of which shall be not less than twelve (12) inches in thickness, shall be constructed around said storage tank extending up to the top of said tank, and the space between the tank and the walls thereof shall be filled with earth.

The concrete to be used in such construction shall be a 1—1/2—3-mixture, meaning one (1) cubic foot or one bag of cement, and one and a half (1½) cubic feet of sand, and three (3) cubic feet of stone, with sufficient water.

The cement to be used shall be of a standard make that has been accepted on work of general construction for at least three (3) years.

The sand shall be clean, sharp, well graded and free from an objectional amount of clay, and possess such qualities as are requisite in good construction.

The stone shall be either broken stone or gravel, the largest pieces of which shall not exceed three-quarters (¾) of an inch, uniformly graded from three-quarters (¾) of an inch to one-quarter (¼) of an inch. The stone or gravel shall be clean, rough, durable and show no evidences of any chemical decomposition.

All concrete work on the receptacle or box shall conform to accepted practice in good construction to the end that a dense mixture of concrete will result.

The construction of all concrete receptacles or boxes shall be under the supervision of the Street Committee of the Town Council of The Town of Dover, or under the supervision of some competent experienced person employed by the Street Committee of The Town of Dover, and the expenses of a supervisor so employed shall be paid by the person, firm, association or corporation holding the permit for the installation of such tank or tanks.

E.  Where two or more tanks are installed there shall be at least two (2) feet of space filled with earth, dividing each tank.

F.  No tank shall be connected to another so as gasoline can flow from one to another.
